A BILL FOR AN ACT

 

 

RELATING TO STATE EMPLOYEES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 84-2, Hawaii Revised Statutes, is amended to read as follows:

     "§84-2  Applicability.  (a)  This chapter shall apply to every nominated, appointed, or elected officer, employee, and candidate to elected office of the State and for election to the constitutional convention, but excluding justices and judges; provided that in the case of elected delegates and employees of the constitutional convention, this chapter shall apply only to the enforcement and administration of the code of ethics adopted by the constitutional convention.

     (b)  This chapter shall continue to apply to any intern whose internship with the State extends beyond one hundred eighty days."

     SECTION 2.  Section 84-3, Hawaii Revised Statutes, is amended as follows:

     1.  By adding a new definition to be appropriately inserted and to read:

     ""Intern" means any individual:

     (1)  Who performs unpaid services for the State for      or more hours per week as part of an internship program established by a private or public secondary or post-secondary educational institution; or

     (2)  Who is employed by a private sector employer and has taken an unpaid leave of absence from the private sector employer to instead work for the State for a fixed period of time."

     2.  By amending the definition of "employee" to read:

     ""Employee" means any nominated, appointed, or elected officer [or], employee, or intern of the State, including members of boards, commissions, and committees, and employees under contract to the State or of the constitutional convention, but excluding legislators, delegates to the constitutional convention, justices and judges."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2112.

Description:

Subjects interns who work for the State to the state ethics code by defining and including the term "intern" in the definition of employees, who are subject to the provisions of the code.  Effective 7/1/2112.  (HD1)
