SECTION 2.  Section 121-45, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

         (A)  Students whose household income is no greater than the most recent Poverty Guidelines for Hawaii as determined by the United States Department of Health and Human Services; and

SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2013-2014 and the same sum or so much thereof as may be necessary for fiscal year 2014-2015 to provide tuition assistance to members of the Hawaii national guard who are students working toward a degree on any campus of the University of Hawaii system.

The sums appropriated shall be expended by the department of defense for the purposes of this Act.

SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

SECTION 5.  This Act shall take effect on July 1, 2013.
