A BILL FOR AN ACT
relating to the office of information practices.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Section 92-1.5, Hawaii Revised Statutes, is amended to read as follows:
"[[]§92-1.5[]] Administration
of this part. (a) The director of the office of information
practices shall administer this part. The director shall establish procedures
for filing and responding to complaints filed by any person concerning the
failure of any board to comply with this part. The director of the office of
information practices shall submit an annual report of these complaints along
with final resolution of complaints, and other statistical data to the
legislature, no later than twenty days prior to the convening of each regular
session.
(b) There is created in the office of information practices for administrative purposes, a board of information practices composed of nine members who shall be appointed notwithstanding the requirements of section 26-34 as follows:
(1) Three members shall be appointed by the governor;
(2) One member shall be appointed by the president of the senate;
(3) One member shall be appointed by the speaker of the house of representatives; and
(4) One member shall be appointed, subject to the approval of the council of the respective county or city and county, by each of:
(A) The mayor of the county of Hawaii;
(B) The mayor of the city and county of Honolulu;
(C) The mayor of the county of Kauai; and
(D) The mayor of the county of Maui.
Vacancies in these positions shall be filled in the same manner. The term of each member of the board of information practices shall be three years. Members of the board of information practices shall be entitled to reimbursement for reasonable travel expenses incurred in the course of their official duties. The board of information practices shall determine its internal rules of procedure. The office of information practices shall provide administrative support to the board of information practices.
(c) The director of the office of information practices shall provide a reasonable opportunity for the board to comment on proposals and reports produced or distributed by the director of information practices on matters including proposed administrative rules, budgets, and proposed legislation. The board shall perform other functions as required by law or by administrative rule adopted by the director of the office of information practices pursuant to chapter 91."
SECTION 2. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 3. This Act shall take effect on July 1, 2011.
