A BILL FOR AN ACT

 

 

Relating to the department of business, Economic Development, and Tourism.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that in today's economic environment, government is left with diminishing financial resources due to rising operating expenses.  The legislature further finds that the private sector in the State has shown a desire to engage the public sector in collaborative and constructive projects that can deliver infrastructure and public asset projects more effectively and efficiently.  The legislature also finds that government is not currently equipped to engage the private sector in a way that can expeditiously execute public-private partnerships when the opportunity arises.

     The purpose of this Act is to establish an office of public-private partnership within the department of business, economic development, and tourism.

     SECTION 2.  Chapter 201, Hawaii Revised Statutes, is amended by adding a new part to be appropriately designated and to read as follows:

"PART    .  OFFICE OF PUBLIC-PRIVATE PARTNERSHIP

     §201-    Office of public-private partnership; established.  There is established within the department an office of public-private partnership to increase economic development in the State through collaboration between the public and private sectors.

     §201-    Duties.  The office of public-private partnership shall:

     (1)  Create a strategic plan that includes:

         (A)  Objectives and goals for the office and criteria to measure the goals;

         (B)  Potential public-private projects that meet the office's objectives and goals;

         (C)  The necessary finances to establish and maintain the office; and

         (D)  The necessary finances to develop, implement, and maintain the potential public-private projects;

     (2)  Coordinate collaboration amongst state agencies to analyze and develop public-private partnership projects based on the needs and goals of the agency and State;

     (3)  Create and maintain an analysis report for each public-private partnership project that shall include:

         (A)  Proposed economic benefits;

         (B)  Potential financial outcomes;

         (C)  Contract terms and conditions; and

          (D)  Social benefits; and

     (4)  In collaboration with agencies and private businesses, oversee and implement each public-private project."

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2017-2018 and the same sum or so much thereof as may be necessary for fiscal year 2018-2019 to establish and implement the office of public-private partnership and to establish positions to implement the purposes of this Act; provided that the positions may be added to the position count for the department of business, economic development, and tourism.

     The sums appropriated shall be expended by the department of business, economic development, and tourism for the purposes of this Act.


     SECTION 4.  This Act shall take effect on July 1, 2017.
