A BILL FOR AN ACT

 

 

relating to public utilities.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the public order is threatened if illegal occupants on real property may have electric power connections installed upon the property or have an account or service transferred to a power connection on illegally occupied property.

     The purpose of this Act is to ensure that only legal occupants on real property may have an electric power connection installed upon the premises or have an account or service transferred to that power connection.

     SECTION 2.  Chapter 269, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§269-     Installation; transfers; prohibited; when.  (a)  No electric utility may install a power connection or transfer the account or service associated with that power connection unless the electric utility obtains written and notarized authorization:

     (1)  From the owner of record of the premises, or the authorized agent of record, to perform the installation of the power connection; or

     (2)  From the occupant of the premises upon which is installed the power connection, to transfer the account or service associated with that power connection.

     (b)  If the occupant of the premises is not the owner of record, or the authorized agent of record, the written and notarized authorization shall describe the nature of the occupant's tenancy on the premises that has a power connection installed upon it.  The types of tenancies described in the authorization may include the types of arrangements covered under the residential landlord-tenant code, including rental agreements, subleases, or assignments.

     (c)  Subsection (a)(2) shall not apply if an account or service is being restarted in the name of the holder of that account or service following a power disconnection due to the nonpayment by the holder of that account."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
