A BILL FOR AN ACT
RELATING TO ECONOMIC DEVELOPMENT.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The Hawaiian Homes Commission Act, 1920, as amended, is amended by adding a new section to be appropriately designated and to read as follows:
"§ Native Hawaiian corporation; establishment. There is established the Native Hawaiian corporation, which shall be a body corporate and a public instrumentality of the State, to be placed under the department of Hawaiian home lands for administrative purposes. The Native Hawaiian corporation shall have the purpose of receiving and managing:
(1) The public lands designated as "available lands" in section 203 of the Hawaiian Homes Commission Act, 1920, as amended;
(2) The public lands conveyed to the State pursuant to section 5(f) of the Admission Act, commonly referred to as "ceded lands"; and
(3) Any other lands to which Native Hawaiians and Hawaiians may be entitled for the benefit of Native Hawaiians.
These lands collectively shall be referred to as the "Native Hawaiian lands"."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
