A BILL FOR AN ACT
relating to Menus for Children.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that restaurants typically offer refillable soda and fruit drink options with meals for children. These beverages often contain copious amounts of sugar or other sweeteners that may lead to health complications such as diabetes, obesity, and tooth decay. Parents who desire a healthy drink alternative for their child are often required to pay an extra fee for a milk or bottled water beverage. This usually results in most parents choosing the sweetened drink and their child consuming multiple servings of a beverage that contributes to obesity, diabetes, and tooth decay.
The purpose of this Act is encourage families to make health beverage choices for their children, by prohibiting restaurants from offering any drink except bottled water and milk on menus for children.
SECTION 2. Chapter 321, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§321- Restaurant meals for children. (a) No restaurant children's menu shall contain a listing of any beverage except bottled water and milk.
(b) This section does not prohibit a restaurant from offering for sale, on a menu other than a children's menu, any nonalcoholic beverage to a minor for a separate charge.
(c) For purposes of this section:
"Children's menu" means a separate menu, or designated section of a menu, containing meal options specifically targeted for children.
"Restaurant" means an eating establishment, including coffee shops and sandwich stands, that gives or offers for sale food to the public, guests, or employees. The term "restaurant" includes a bar area within the restaurant and outdoor areas of restaurants. The term "restaurant" does not include private and public school cafeterias."
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on January 1, 2016.
