STATE OF HAWAII

A BILL FOR AN ACT

 

 

MAKING AN APPROPRIATION FOR SHERIFF POSITIONS IN THE THIRD CIRCUIT.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

     SECTION 1.  The District courts on the Big Island in North Kohala and Hamakua have had to close due to a shortage of state deputy sheriffs since October 1, 2010.  The closures have placed immense hardship on people of the Big Island who have been forced to travel long distances to reach the South Kohala courthouse.  The shortage of state deputy sheriffs has also compromised security for the protection of judges, court staff, attorneys, and the public in other courthouses on the Big Island.  The department of public safety requires at least two sheriffs per courthouse.

     The purpose of this Act is to make an appropriation to the department of public safety to increase or restore the number of state deputy sheriff positions in the third circuit.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $154,944 or so much thereof as may be necessary for fiscal year 2011-2012 and the same sum or so much thereof as may be necessary for fiscal year 2012-2013 for:

     (1)  Three deputy sheriff II positions, SR 18, at $37,968 per year; and

     (2)  One deputy sheriff III position, SR 20, at $41,040 per year;

provided that the courthouses in North Kohala and Hamakua shall reopen as a condition of this appropriation.

     The sums appropriated shall be expended by the department of public safety for the purposes of this Act.

     SECTION 3.  This Act shall take effect on July 1, 2011.
