HOUSE RESOLUTION

 

 

Requesting the department of taxation and the counties to issue to each compliant short-term rental operator in the State, written proof of compliance with state and county transient accommodations laws to facilitate full compliance with those laws by short-term rental operators and platforms.

 

 

 


     WHEREAS, short-term rentals have significantly increased in number and use within the State; and

 

     WHEREAS, the market for short-term rentals creates issues that need to be addressed, ranging from taxation to public safety concerns; and

 

     WHEREAS, online short-term rental platforms for short-term rentals have become the most used method in the State for providing short-term rentals; and

 

     WHEREAS, online short-term rental platforms have stated their willingness to work with the State and counties to ensure compliance with applicable laws; and

 

WHEREAS, online short-term rental platforms have stated that they seek short-term rental operators who are in full compliance with state and county laws; and

 

     WHEREAS, verification of compliance with applicable laws to online short-term rental businesses consists of the short-term rental operator checking a box on their online registration form; and

 

     WHEREAS, the ease at which short-term rental operators can be dishonest about their compliance with state and county laws in their registration with online short-term rental platforms is troubling; and

 

     WHEREAS, applicable state and county agencies should assist online short-term rental platform's expressed intent and commitment of requiring their operators to be fully compliant with local laws by making it as easy as possible to supply proof of compliance by the State and county; now, therefore,

 

     BE IT RESOLVED, by the House of Representatives of the Twenty-ninth Legislature of the State of Hawaii, Regular Session of 2017, that the Department of Taxation and the counties are requested to issue to each compliant short-term rental operator in the State, written proof of compliance with state and county transient accommodations laws to facilitate full compliance with those laws by short-term rental operators and platforms; and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Director of Taxation, Director of Finance of the County of Hawaii, Director of the Department of Budget and Fiscal Services of the City and County of Honolulu, Director of the Department of Finance of the County of Maui, and the Director of Finance of the County of Maui.
