HOUSE RESOLUTION

 

 

urging the department of the attorney general to establish a working group to review legislation to identify obsolete provisions and make recommendations to address obsolete provisions.

 

 

     WHEREAS, the Hawaii Revised Statutes are a cumulative compilation of legislation enacted in the original legislative session convened in 1959, through the most recent legislative session ending in 2010; and

 

     WHEREAS, while each new session the legislature considers repealing and amending out-of-date provisions of the Hawaii Revised Statutes, the focus must be on enacting and amending provisions to respond to the current needs of the state, and obsolete legislation often remains in the Hawaii Revised Statutes past its application or relevance; and

 

     WHEREAS, the legislature's resources are consumed by the comprehensive duties of prospective lawmaking and responding to the immediate concerns and needs of constituents; and

 

     WHEREAS, obsolete legislation:

 

     (1)  Reduces the efficient and the streamlined application of Hawaii law;

 

     (2)  May confuse the public and threaten confidence in the legislature; and

 

     (3)  May conflict with newer laws;

 

now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2011, that the Department of the Attorney General is urged to establish a working group to:

 

     (1)  Review the Hawaii Revised Statutes and identify obsolete legislation; and  

 

     (2)  Report to the legislature no later than 20 days prior to the convening of the 2012 Regular Session, with recommendations regarding the obsolete provisions identified; and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Attorney General.
