STATE OF HAWAII

 

 

 

 

 

HOUSE RESOLUTION

 

 

requesting the Board of Land and Natural Resources to establish small boat harbor advisory groups.

 

 

 


     WHEREAS, state small boat harbors are constructed, maintained, and operated for recreational boating activities, the landing of fish, and commercial vessel activities; and

 

     WHEREAS, Act 272, Session Laws of Hawaii 1991, transferred the administrative jurisdiction for boating and other ocean-based recreational activities from the Department of Transportation to the Department of Land and Natural Resources; and

 

     WHEREAS, pursuant to section 200-12, Hawaii Revised Statutes, the Division of Boating and Ocean Recreation administers state small boat harbors and the state comprehensive recreational boating program; and

 

     WHEREAS, the establishment of local advisory groups for state small boat harbors would allow the Division of Boating and Ocean Recreation to more effectively address the unique challenges related to administering each state small boat harbor; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-eighth Legislature of the State of Hawaii, Regular Session of 2015, that the Board of Land and Natural Resources is requested to establish small boat harbor advisory groups to advise the Division of Boating and Ocean Recreation on matters relating to the administration of state small boat harbors; and

 

     BE IT FURTHER RESOLVED that the Board of Land and Natural Resources is requested to establish the state small boat harbor advisory groups on a regional basis, including one advisory group for each of the following geographical regions:

 

     (1)  West Hawaii;

 

     (2)  East Hawaii;

 

     (3)  The island of Maui;

 

     (4)  The island of Kauai;

 

     (5)  The North and West shores of the island of Oahu;

 

     (6)  The South shore of the island of Oahu;

 

     (7)  The island of Molokai; and

 

     (8)  The island of Lanai; and

 

     BE IT FURTHER RESOLVED that the Legislature requests that each small boat harbor advisory group be composed of seven members who are users of small boat harbors in the advisory group's geographical region or possess expertise relevant to the administration of small boat harbors, to be selected at the discretion of the Board of Land and Natural Resources; provided that the Legislature requests that each advisory group include amongst its members:

 

     (1)  Both commercial and recreational users of small boat harbors in the advisory group's geographical region; and

 

     (2)  Not less than four users from small boat harbors within the advisory group's geographical region; and

 

     BE IT FURTHER RESOLVED that each small boat harbor advisory group is requested to advise the Division of Boating and Ocean Recreation on the:

 

     (1)  Adoption of administrative rules;

 

     (2)  Comprehensive recreational boating program; and

 

     (3)  Development of permit and fees for moorage,

 

as they relate to state small boat harbors within the advisory group's geographical region; and

 

     BE IT FURTHER RESOLVED that each small boat harbor advisory group may request a written response from the Division of Boating and Ocean Recreation regarding a specific issue or concern relating to the administration of state small boat harbors within the advisory group's geographical region; and

 

     BE IT FURTHER RESOLVED that the Division of Boating and Ocean Recreation is requested to provide a written response specifically addressing each issue and concern raised in the small boat harbor advisory group's request for a written response; and

 

     BE IT FURTHER RESOLVED that if a small boat harbor advisory group determines that the Division of Boating and Ocean Recreation's written response inadequately addresses an issue or concern, the small boat harbor advisory group may appeal the issue or concern to the Board of Land and Natural Resources; and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Chairperson of the Board of Land and Natural Resources and the Administrator of the Division of Boating and Ocean Recreation.
