HOUSE RESOLUTION

 

 

REQUESTING THE CONVENING OF A LAND TRANSFER TASK FORCE TO REVIEW CERTAIN LANDS FOR EXCHANGE BETWEEN THE DEPARTMENT OF HAWAIIAN HOME LANDS AND DEPARTMENT OF LAND AND NATURAL RESOURCES.

 

 


     WHEREAS, the Department of Hawaiian Home Lands, which is led by the Hawaiian Homes Commission, has the duty to manage and administer certain lands for lease to native Hawaiians pursuant to the Hawaiian Homes Commission Act, 1920; and

 

     WHEREAS, the Department of Land and Natural Resources, which is led by the Board of Land and Natural Resources, has the duty to manage and administer certain public lands of the State, including forests and forest reserves, state parks, and historic sites; and

 

     WHEREAS, certain lands under the Department of Hawaiian Home Lands' jurisdiction may be better suited for the purposes of the Department of Land and Natural Resources; and

 

     WHEREAS, approximately sixty thousand acres of conservation land are under the jurisdiction of the Department of Hawaiian Home Lands; and

 

     WHEREAS, certain lands under the Department of Land and Natural Resources' jurisdiction may be better suited for use as Hawaiian Home Lands; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Thirty-first Legislature of the State of Hawaii, Regular Session of 2022, that the following individuals, or their respective designees, are requested to convene and serve on a Land Transfer Task Force:

 

     (1)  The Chair and Vice Chair of the Senate standing committee with primary jurisdiction over water and land subject matter;

 

     (2)  The Chair and Vice Chair of the Senate standing committee with primary jurisdiction over Hawaiian affairs subject matter;

 

     (3)  The Chair and Vice Chair of the House standing committee with primary jurisdiction over water and land subject matter;

 

     (4)  The Chair and Vice Chair of the House standing committee with primary jurisdiction over Hawaiian affairs subject matter;

 

     (5)  The Chairperson of the Hawaiian Homes Commission;

 

     (6)  The Chairperson of Board of Land and Natural Resources;

 

     (7)  The Homestead Services Administrator of the Department of Hawaiian Home Lands;

 

     (8)  The Land Management Administrator of the Department of Hawaiian Home Lands;

 

     (9)  The Administrator of the Division of Forestry and Wildlife of the Department of Land and Natural Resources; and

 

    (10)  The Administrator of the Land Division of the Department of Land and Natural Resources; and

 

     BE IT FURTHER RESOLVED that the Land Transfer Task Force is requested to:

 

     (1)  Make an inventory of lands under the Department of Hawaiian Home Lands' jurisdiction that may be better suited for the purposes of the Department of Land and Natural Resources;

 

     (2)  Make an inventory of lands under the Department of Land and Natural Resources' jurisdiction that may be better suited for the purposes of the Department of Hawaiian Home Lands;

     (3)  Ascertain the process to transfer appropriate lands from the Department of Hawaiian Home Lands to the Department of Land and Natural Resources, and vice versa; and

 

     (4)  Determine the challenges and potential remedies necessary to facilitate the transfers of appropriate lands between the Department of Hawaiian Home Lands and the Department of Land and Natural Resources; and

 

     BE IT FURTHER RESOLVED that the Land Transfer Task Force is requested to conduct its work through meetings; informational briefings; and consultations with relevant parties, including lessees; and

 

     BE IT FURTHER RESOLVED that the Department of Hawaiian Home Lands and the Department of Land and Natural Resources are requested to provide any necessary administrative support, including preparation of the report requested below, to the task force; and

 

     BE IT FURTHER RESOLVED that the Land Transfer Task Force is requested to submit a report of its findings and recommendations, including any proposed legislation, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2023; and

 

     BE IT FURTHER RESOLVED that the Land Transfer Task Force shall dissolve on July 1, 2023; and

 

     BE IT FURTHER RESOLVED that certified copies of this Resolution be transmitted to the Governor; Chairperson of the Hawaiian Homes Commission; Chairperson of Board of Land and Natural Resources; Homestead Services Administrator of the Department of Hawaiian Home Lands; Land Management Administrator of the Department of Hawaiian Home Lands; Administrator of the Division of Forestry and Wildlife of the Department of Land and

Natural Resources; and Administrator of the Land Division of the Department of Land and Natural Resources.
