HOUSE CONCURRENT

RESOLUTION

 

 

REQUESTING THE DEPARTMENT OF TRANSPORTATION to conduct a study CONCERNING THE REGISTRATION AND PERMITTING OF PRIVATELY OWNED RECONSTRUCTED VEHICLES.

 

 


     WHEREAS, in 1977, the Legislature enacted Act 77 Session Laws of Hawaii 1977, relating to reconstructed vehicles; and

 

     WHEREAS, Act 77, as codified in chapter 286, Hawaii Revised Statutes, defined reconstructed vehicles and required all reconstructed vehicles in the State to be inspected and certified by a designated county agency; and

 

                WHEREAS, in section 286-2, Hawaii Revised Statutes, a reconstructed vehicle is defined as:

 

     "a vehicle that is registered to be operated on a public highway, and that is:

 

(1)  Assembled from new or used parts by a person other than a recognized manufacturer of new vehicles;

 

(2)  Modified to the extent that the identity of the vehicle's make, model, or type is obscured by material changes in its appearance; or

 

(3)  Modified by the removal, addition, alteration, or substitution of other than original replacement essential parts, including the vehicle's body, power train, steering system, suspension system, exhaust system, intake system, or bumper system;

 

excluding ordinary body repair that does not change the exterior structure of the vehicle.  The term does not include a special interest vehicle or a motorcycle"; and

 

     WHEREAS, in 1986, the Legislature enacted Act 122 Session Laws of Hawaii 1986, relating to reconstructed vehicles; and

 

     WHEREAS, Act 122 amended section 286-85, Hawaii Revised Statutes, by making the inspection and certification requirement inapplicable to privately owned reconstructed vehicles in counties with a population of less than 500,000; and

 

     WHEREAS, from 1986 through today, the City and County of Honolulu is the only county in the State that has a population over 500,000; and

 

     WHEREAS, the City and County of Honolulu is the only county in the State in which inspection and certification of reconstructed vehicles is required, despite the use of reconstructed vehicles in all other counties; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-eighth Legislature of the State of Hawaii, Regular Session of 2015, the Senate concurring, that the Department of Transportation is requested to conduct a study that:

 

(1)  Examines the circumstances that gave rise to and the purpose of limiting the registration and permitting requirements for privately owned reconstructed vehicles to the City and County of Honolulu; and

 

(2)  Recommends whether the registration and permitting requirement for privately owned reconstructed vehicles should be applicable in all counties; and

 

     BE IT FURTHER RESOLVED the Department of Transportation is requested to report its findings and recommendations to the Legislature no later than twenty days prior to convening of the 2016 Regular Session; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of Transportation and the mayor of each county.
