HOUSE CONCURRENT

RESOLUTION

 

 

requesting the convenING OF a task force to review and make recommendations on resolving user conflicts in harbors statewide.

 

 

 


     WHEREAS, harbor facilities serve many important purposes in Hawaii; and

 

     WHEREAS, most of the State's harbors are the site of diverse uses such as commercial and recreational boating; commercial, recreational, and subsistence fishing; paddling; surfing; swimming; and traditional and customary native Hawaiian gathering or cultural practices; and

 

     WHEREAS, while it is often possible for individuals and communities to pursue their diverse harbor uses in concert with each other, conflicts sometimes arise when certain uses appear to be fundamentally incompatible; and

 

     WHEREAS, Hawaii has a long-standing and strong tradition of protecting access to ocean resources for all members of the community; and

 

     WHEREAS, thoughtful management with the goal of preserving access for as many harbor users as possible in the spirit of mutual respect for each other and for the environment can help greatly reduce conflicts among harbor users; and

 

     WHEREAS, throughout the State, significant harbors that are important to a wide variety of users are located on or closely affect land that is under the jurisdiction of the Department of Hawaiian Home Lands; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-seventh Legislature of the State of Hawaii, Regular Session of 2014, the Senate concurring, that the Department of Hawaiian Home Lands is requested to convene a task force to review and make recommendations on resolving user conflicts in harbors statewide; and

 

     BE IT FURTHER RESOLVED that the Chairperson of the Hawaiian Homes Commission convene and chair the task force to be composed of the following members:

 

     (1)  One representative each of the Harbor Masters of each of the four district offices of the Division of Boating and Ocean Recreation;

 

     (2)  The Administrator of the Division of Aquatic Resources or the Administrator's designee;

 

     (3)  The Chairperson of the Board of Land and Natural Resources or the Chairperson's designee;

 

     (4)  The Chief of Enforcement of the Division of Conservation and Resource Enforcement, or the Chief's designee;

 

     (5)  The Chair of the House Standing Committee on Ocean, Marine Resources, and Hawaiian Affairs;

 

     (6)  The Chair of the House Standing Committee on Water & Land;

 

     (7)  The Chair of the Senate Standing Committee on Hawaiian Affairs;

 

     (8)  The Chair of the Senate Standing Committee on Water and Land;

 

     (9)  The Chairperson of the Board of Trustees of the Office of Hawaiian Affairs; and

 

    (10)  The Chair of the Aha Moku Advisory Committee or the Chair's designee; and

 

     BE IT FURTHER RESOLVED that the task force is requested to submit a report of its findings and recommendations, including any proposed legislation, to the Legislature no later than 20 days before the convening of the Regular Session of 2015; and

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to Chairperson of the Hawaiian Homes Commission, the Administrator of the Division of Boating and Ocean Recreation, Administrator of the Division of Aquatic Resources, Chairperson of the Board of Land and Natural Resources, Chief of Enforcement of the Division of Conservation and Resource Enforcement, Chairperson of the Board of Trustees of the Office of Hawaiian Affairs, and the Chair of the Aha Moku Advisory Committee.
