HOUSE CONCURRENT

RESOLUTION

 

 

REQUESTING the State department of transportation to convene a drone policy task force and recommend a statewide policy for unmanned aircraft that protects privacy and allows the use of unmanned aircraft systems for public and private applications.

 

     WHEREAS, civilian use of unmanned aerial vehicles or unmanned aircraft systems, more popularly known as "drones", is on the rise; and

 

WHEREAS, drones have many potentially useful and life-saving applications, both commercial and non-commercial, and these uses include: emergency search and rescue operations; fighting forest fires; helping farmers apply fertilizer and pesticides in a more targeted manner; invasive species detection and control; watershed management; earthquake and tsunami damage assessment and relief operations; motor vehicle traffic management; lava flow monitoring; aerial photography and videography; land use surveys; and geographical, geological, and archaeological surveys; and

 

     WHEREAS, it is foreseeable that in developing these applications, many research, education, and business opportunities will arise, and so will the need for common-sense regulation, to complement any emerging federal regulation and safely integrate unmanned aircraft systems into the State's airspace while protecting privacy rights, while involving the public in decision-making, and resolving conflicts that may arise; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-eighth Legislature of the State of Hawaii, Regular Session of 2015, the Senate concurring, that this body hereby requests the state Department of Transportation to convene a Hawaii Drone Policy Task Force (Task Force); and

 

     BE IT FURTHER RESOLVED that the Task Force shall be comprised of:

 

(1)  The Director of Transportation or the Director's designee;

 

(2)  The Director of Business, Economic Development, and Tourism or the Director's designee;

 

(3)  The Director of Commerce and Consumer Affairs or the Director's designee;

 

(4)  The Adjutant General or the Adjutant General's designee;

 

(5)  The Attorney General or the Attorney General's designee; and

 

(6)  At least one resident of each county who has a background in aviation, privacy law, or civil liberties law; and

 

BE IT FURTHER RESOLVED that the Director of Transportation

shall serve as Chairperson of the Task Force; and

 

     BE IT FURTHER RESOLVED that the Task Force is requested to

submit a report of its findings and recommendations, including any proposed legislation, to the Legislature no later than twenty days prior to the convening of the Regular Session of 2016; and

 

     BE IT FURTHER RESOLVED that the report include:

 

(1)  An analysis of the regulations and guidance from the Federal Aviation Administration regarding unmanned aircraft systems;

 

(2)  An analysis of the Federal Aviation Administration's "Integration of Civil Unmanned Aircraft Systems (UAS) in the National Airspace System (NAS) Roadmap," report issued November 7, 2013, and its application to the development of unmanned aircraft systems in the State;

 

(3)  Written recommendations for a comprehensive state policy for unmanned aircraft that protects privacy and ensures public safety, while allowing the use of unmanned aircraft systems for public and private applications; and

 

     (4)  Recommendations, if any, for proposed legislation; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of Transportation, Director of Business, Economic Development, and Tourism, Director of Commerce and Consumer Affairs, Adjutant General, Attorney General, and respective Mayors of the County of Maui, County of Kauai, City and County of Honolulu, and County of Hawaii.
