HOUSE CONCURRENT
RESOLUTION
URGING THE COUNTIES TO CREATE AGENCIES TO AUDIT AND OVERSEE assessment collection by HOMEOWNERS ASSOCIATIONS.
WHEREAS, no statutory framework or oversight agency exists in Hawaii to govern the rights of voluntary homeowners associations to collect assessments; and
WHEREAS, inconsistent court decisions have failed to provide judicial oversight or clarification regarding these rights; and
WHEREAS, some homeowners associations collect assessments of more than $1,000,000 per year, with no agency to audit or oversee the process; and
WHEREAS, some homeowners associations have been unable to collect assessments from individual lot owners, preventing needed improvements to their subdivisions; and
WHEREAS, the general public may be affected when subdivisions fail to make needed improvements; for example, when substandard roads delay emergency response vehicles; now, therefore,
BE IT RESOLVED by the House of Representatives of the Thirtieth Legislature of the State of Hawaii, Regular Session of 2019, the Senate concurring, that the counties are urged to create agencies to audit and oversee assessment collection by homeowners associations within their counties; and
BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Mayor of Hawaii County, the Mayor of the City and County of Honolulu, the Mayor of Kauai County, and the Mayor of Maui County.
