HOUSE CONCURRENT

RESOLUTION

 

 

requesting that the department of commerce and consumer affairs adopt rules to require installers of aftermarket mobile electronics to educate customers regarding applicable noise laws; the county police departments vigorously enforce laws relating to prohibited noise; and motor vehicle owners be respectful of others when using their audio equipment.

 

 

 


     WHEREAS, noise, in the form of excessively amplified music played in public areas, is a public nuisance; and

 

     WHEREAS, motor vehicles that produce excessively amplified music are often equipped with aftermarket audio equipment; and

 

     WHEREAS, section 41-31.1, Revised Ordinances of Honolulu, and section 22-14.1, Kauai County Code, prohibit the use of audio equipment in a motor vehicle if the sound produced is audible at a distance of thirty feet from the audio equipment; and

 

     WHEREAS, section 14-18, Hawaii County Code, and section 9.36.030, Maui County Code, prohibit the use of audio equipment in a motor vehicle if the sound produced is audible at a distance of fifty feet from the audio equipment; now, therefore,

 

     BE IT RESOLVED by the House of Representatives of the Twenty-sixth Legislature of the State of Hawaii, Regular Session of 2011, the Senate concurring, that the Department of Commerce and Consumer Affairs is requested to adopt rules under chapter 91, Hawaii Revised Statutes, to require businesses that sell and install mobile electronics, including but not limited to car stereos and other audio equipment, to educate customers regarding applicable noise laws; and

 

     BE IT FURTHER RESOLVED that the police departments of the respective counties are requested to vigorously enforce the applicable ordinances and county code provisions related to prohibited noise produced by audio equipment in motor vehicles; and

 

     BE IT FURTHER RESOLVED that vehicle owners with aftermarket audio equipment installed in their motor vehicles are requested to be respectful of others when using their audio equipment; and

 

     BE IT FURTHER RESOLVED that certified copies of this Concurrent Resolution be transmitted to the Director of Commerce and Consumer Affairs, the Chief of Police of each county, and the Chairperson of the Council of each county.
