A BILL FOR AN ACT

 

 

relating to prepaid HealthCare.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 393-3, Hawaii Revised Statutes, is amended by adding a new definition to be appropriately inserted and to read as follows:

     ""Qualified Independent Contractor" means a person who would be classified as an independent contractor under the common law employee test and is routinely employed by the same employer for six consecutive months or more."

     SECTION 2.  Section 393-3, Hawaii Revised Statutes, is amended by amending the definition of "Regular Employee" to read as follows:

     ""Regular employee" means a person employed in the employment of any one employer for at least twenty hours per week including a qualified independent contractor, but does not include a person employed in seasonal employment.  "Seasonal employment" for the purposes of this paragraph means employment in a seasonal pursuit as defined in section 387-1 by a seasonal employer during a seasonal period or seasonal periods for the employer in the seasonal pursuit or employment by an employer engaged in the cultivating, harvesting, processing, canning, and warehousing of pineapple during its seasonal periods.  The director by rule and regulation may determine the kind of employment that constitutes seasonal employment."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2017.
