A BILL FOR AN ACT

 

 

RELATING TO INTOXICATING LIQUOR.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 281, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§281-     Caffeinated beer beverage; pre-mixed drink.  (a)  No person shall sell, offer for sale, or otherwise distribute any caffeinated beer beverage in the State labeled as a "pre-mixed drink".

     (b)  As used in this section, "caffeinated beer beverage" means a beverage defined as beer pursuant to section 281-1, to which caffeine has been added as a food additive, and which contains at least one-half of one per cent caffeine by volume.  For purposes of this section, the term "food additive" shall have the same meaning as defined in Section 201(s) of the Federal Food, Drug, and Cosmetic Act.  This section does not apply to alcohol beverages made with ingredients that contain naturally occurring caffeine, including coffee, tea, cacao, or extracts derived from these foods."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
