A BILL FOR AN ACT
RELATING TO POLICING.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The legislature finds that public trust in law enforcement is critical to ensuring justice for all under the law. The legislature further finds that data collection is one essential tool to allow the public, police, and policymakers to analyze the effectiveness of existing practices, determine which policies work and do not work, and support policy decisions with clear and relevant data.
Numerous states and the District of Columbia have enacted laws to standardize the collection of complete and accurate policing stop data to increase community trust, transparency, and internal accountability for public safety through data analysis. Similarly, in 2020, Hawaii enacted Act 47, Session Laws of Hawaii 2020, to standardize best practices for the use of force between the counties.
The purpose of this Act is to enhance the public's trust in law enforcement and continue to standardize best practices for the data collection of police stops, arrests, and use of force between the counties in Hawaii by requiring each county police department to collect, report, and publicly publish certain data regarding police stops, arrests, uses of force, and trends.
SECTION 2. Chapter 52D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§52D- Police
stops; arrests; uses of force; data collection; report to legislature. (a) The chief of each county police department
shall submit to the legislature no later than January 31 of each year an annual
report with a summary of data and visual displays, including but not limited to
graphs and charts, relating to police stops, arrests, uses of force, and trends
relating to police stops, arrests, and uses of force. The reporting period of each report shall be
from January 1 to December 31 of the year immediately before the year of the
report submission.
(b) The report shall include data concerning:
(1) All police stops, including the
following information:
(A) The date, time, and location of the
stop;
(B) The approximate duration of the
stop;
(C) The reason for the initial stop;
(D) Whether a search was conducted as a
result of the stop, and, if a search was conducted:
(i) The reason for the search;
(ii) Whether the search was consensual or
nonconsensual;
(iii) Whether person, property, or both
was searched; and
(iv) Whether contraband or property was
seized during the search;
(E) The final outcome of the stop:
(i) Whether a warning was issued, and if
so, the reasons for the warning;
(ii) Whether a citation was issued, and
if so, the citation charged; and
(iii) Whether an arrest was made, and if
so, the criminal offense or offenses charged;
(F) The age, race, ethnicity, and sex or
perceived age, race, ethnicity, and sex of the person stopped;
(G) Whether force was used, and if so,
the reason for the use of force;
(H) Whether the person stopped exhibited
any signs of mental health issues; and
(I) Whether the person stopped exhibited
any signs of use of alcohol or drugs;
(2) All arrests, including the following
information:
(A) The case number;
(B) The date, time, and location of the
arrest;
(C) The charged offense or offenses;
(D) The age, race, ethnicity, and sex or
perceived age, race, ethnicity, and sex of the person arrested;
(E) The limited English speaking ability
or perceived limited English speaking ability of the person arrested;
(F) The disability status or perceived
disability status of the person arrested;
(G) The mental health status or
perceived mental health status of the person arrested;
(H) The use or perceived use of alcohol
or drugs of the person arrested;
(I) The residential zip code of the
person arrested or if the person is houseless;
(J) The name of the arresting officer
and other officers involved with the arrest; and
(K) The final disposition of the case;
and
(3) All uses of force, including the
following information:
(A) The total number of use of force
incidents and type of force used;
(B) The total number of officers
involved in each use of force incident;
(C) Clarification on whether the use of
force report was filed by the officer using force or another officer observing
the use of force;
(D) The total number of persons involved
in each use of force incident;
(E) The number of civilian complaints
about use of force, including the applicable department policy, outcome, and
any disciplinary action;
(F) If an arrest was made, the criminal
offense or offenses charged;
(G) The age, race, ethnicity, and sex or
perceived age, race, ethnicity, and sex of each person involved in the use of
force incident;
(H) The age, race, ethnicity, and sex of
each officer involved in the use of force incident;
(I) The limited English speaking ability
or perceived limited English speaking ability of each person involved in the
use of force incident;
(J) The disability status or perceived
disability status of each person involved in the use of force incident;
(K) The mental health status or perceived
mental health status of each person involved in the use of force incident; and
(L) The use or perceived use of alcohol
or drugs of the person or persons involved in each use of force incident.
(c) The
chief of each county police department shall post a copy of the report
submitted to the legislature pursuant to this section on the department's
website on an annual basis.
(d) The
chief of each county policy department shall establish and maintain an online
repository in a searchable format for the policing data collection of aggregate
and disaggregate information that is accessible to the public on the department's
website.
(e) The
chief of each county police department shall retain the electronic and paper
records relating to policing stops, arrests, and uses of force in accordance
with law, the department's record retention policy, or at least five years
after the annual report is submitted, whichever period is longer.
(f) For
the purposes of this section, "stop" means a temporary investigation
detention of a person for the purpose of determining whether probable cause
exists to make an arrest. A "stop"
is a seizure of an individual's person and occurs whenever an officer uses the
officer's authority to compel a person to halt or remain in a certain place."
SECTION 3. Section 52D-3.5, Hawaii Revised Statutes, is amended by amending its title to read as follows:
"§52D-3.5 [Reports] Annual
report to legislature[.] of misconduct incidents."
SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 5. This Act shall take effect on December 1, 2023.
