A BILL FOR AN ACT

 

 

RELATING TO THE driver education.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 244D-17, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§244D-17[]]  Disposition of revenues.  All moneys collected pursuant to this chapter shall be paid into the state treasury as state realizations, to be kept and accounted for as provided by law[.]; provided that $           shall be used for programs to prevent persons under the age of twenty-one from operating a motor vehicle while under the influence of alcohol and shall be deposited as follows:

     (1)  $          for the drivers education program established and administered by the department of education for high school students pursuant to section 302A-413;

     (2)  $         for the traffic safety education program established and administered by the department of education pursuant to section 302A-417;

     (3)  $         for the driver education and behind-the-wheel driver training program established and administered by the department of transportation; and

     (4)  $       for the driver education and training programs administered by the judiciary."

     SECTION 2.  Section 286-108.4, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§286-108.4  Driver education and behind-the-wheel driver training program.[]]  The director of transportation is directed to establish and certify a statewide driver education program and behind-the-wheel driver training program, to include the number of course hours, curriculum, and certification of teachers and third-party examiners[.]; provided that the revenues received pursuant to section 244D-17 shall be used for programs to prevent persons under the age of twenty-one from operating a motor vehicle while under the influence of alcohol.  The director of transportation is also directed to set a cost for the programs to enable the programs to be self-sufficient.  The director of transportation shall adopt rules pursuant to chapter 91 necessary for the purposes of this [[]section[]]."

     SECTION 3.  Section 286G-2, Hawaii Revised Statutes, is amended to read as follows:

     "§286G-2  Driver education and training fund.  There is established in the state treasury a special fund to be known as the driver education and training fund.  All driver education assessments collected pursuant to this chapter shall be deposited in the driver education and training fund to be expended by the administrative director of the courts for driver education and training programs administered by the judiciary, subject to part III of chapter 37 to the extent that the same applies to appropriations for the judiciary.  Revenues received pursuant to section 244D-17 shall be used for education and training programs to prevent persons under the age of twenty-one from operating a motor vehicle while under the influence of alcohol."

     SECTION 4.  Section 302A-413, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  The department, for the purpose of this section, shall:

     (1)  Set the prerequisites and priorities for enrollment in the course of driver education and training, which shall be open to every resident of the State who is fifteen years of age or older and under nineteen years of age;

     (2)  Establish the requirements for and employ necessary instructors, who are certified to have completed satisfactorily an approved instructor's course, to conduct the course in driver education and training;

     (3)  Issue a certificate of completion to every student upon satisfactory completion of the course in driver education and training;

     (4)  Purchase, rent, or acquire by gift, materials and equipment necessary for the program established by this section; [and]

     (5)  Cooperate with the chief of police in each county in promoting traffic safety[.]; and

     (6)  Use revenues received pursuant to section 244D-17 for education and training programs to prevent students from operating a motor vehicle while under the influence of alcohol."

     SECTION 5.  Section 302A-417, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§302A-417[]]  Traffic safety education.  (a)  The department may establish and administer a traffic safety education program to be conducted at each public school for students from grades kindergarten through twelve.

     (b)  The department may establish the requirements for the position of traffic safety education specialist and may employ at least one traffic safety education specialist for the purposes of this section.  The traffic safety education specialist may be paid out of fees allocated to the director of commerce and consumer affairs from the special drivers education fund account pursuant to section 431:10C-115.

     (c)  Revenues received pursuant to section 244D-17 shall be used for traffic safety education programs to prevent students from operating a motor vehicle while under the influence of alcohol."

     SECTION 6.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 7.  This Act shall take effect on July 1, 2011.
