A BILL FOR AN ACT
RELATING TO EMPLOYMENT.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 387, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§387-
Paid
breaks; warehouse employees. (a)
An employee who earns an hourly wage shall be entitled to one-half hour
of a paid break for every eight hours of labor performed within a warehouse.
(b) No duration of any paid break required pursuant to this section shall count toward the hours of a workweek for the purposes of overtime compensation pursuant to section 387-3."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2023.
