A BILL FOR AN ACT

 

 

relating to motorcycles.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that certain motorcycles with three wheels are designed to accommodate the operator and a passenger sitting side by side, rather than astride a seat with one leg on each side of the motorcycle.  However, statutes regulating the operation of motorcycles do not currently recognize or provide for the operation of that type of motorcycle, thus preventing the legal sale and operation of otherwise roadworthy vehicles in the State.

     The legislature further finds that Hawaii is the only state in the nation in which this type of three-wheeled motorcycle is not recognized as a legal means of transportation.  This lack of recognition is based on statutory provisions that are meant to apply only to traditional two-wheeled motorcycles, rather than on safety concerns regarding the operation of motorcycles with three wheels.

     Accordingly, the purpose of this Act is to permit operators and passengers of motorcycles with three wheels to ride side by side on motorcycles that are designed for them to ride that way.

     SECTION 2.  Section 291C-152, Hawaii Revised Statutes, is amended by amending subsection (b) to read as follows:

     "(b)  A person shall ride upon a motorcycle only while sitting astride the seat, facing forward, with one leg on each side of the motorcycle[.]; provided that a person riding upon a motorcycle with three wheels that is designed to permit an operator and passenger to sit on seats positioned side by side shall not be required to sit astride a seat with one leg on each side of the motorcycle."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
