A BILL FOR AN ACT

 

 

RELATING TO MEDICAID.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§346-     Medical assistance re-enrollment.  (a)  Beginning January 1, 2014, and every year thereafter, the department shall require all eligible recipients of medical assistance under any Medicaid program administered by the department, including any Medicaid waiver program, to re-enroll in such Medicaid program every year by the anniversary date of the recipient's enrollment or other such date as the department determines to be appropriate.  As part of the re-enrollment process, the recipient shall state on an official form developed by the department that the recipient continues to meet the appropriate program eligibility requirements.

     (b)  The parent or legal guardian of a minor receiving medical assistance under any Medicaid program administered by the department, including any Medicaid waiver program, shall be responsible for fulfilling the requirements of subsection (a) on behalf of the minor recipient.

     (c)  Beginning January 1, 2014, any process or program providing for the automatic re-enrollment of any recipient of medical assistance under any Medicaid program administered by the department shall no longer be effective.

     (d)  The department shall adopt or amend rules pursuant to chapter 91 to effectuate the purposes of this section, including any necessary forms and procedures."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval; provided that section 1 shall be effective upon the approval of any relevant federal agency, including the Centers for Medicare and Medicaid Services, if any approvals are required therefor.
