A BILL FOR AN ACT

 

 

relating to university of hawaii athletics.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

     SECTION 1.  Chapter 304A, Hawaii Revised Statutes, is amended by adding a new subpart to part IV to be appropriately designated and to read as follows:

"   .  UNIVERSITY OF HAWAII AT MANOA ATHLETICS

     §304A-A  University of Hawaii at Manoa athletics; board of governors.  (a)  There is established an athletics department at the University of Hawaii at Manoa, which shall be governed by the board of governors of the athletics department at the University of Hawaii at Manoa.  The powers and duties of the board of governors shall include the following:

     (1)  The administration of the University of Hawaii at Manoa intercollegiate athletics special fund established under section 304A-2176;

     (2)  All powers and responsibilities necessary to maintain and operate an athletics department at the University of Hawaii at Manoa; and

     (3)  The appointment, retention, and termination of the athletics director of the University of Hawaii at Manoa.

The board of governors shall report to the University of Hawaii board of regents.

     (b)  The board of governors shall consist of seven members who shall be appointed as follows:

     (1)  Three members who shall be members of the University of Hawaii board of regents to be appointed by the chair of the University of Hawaii board of regents;

     (2)  One member with financial management experience to be appointed by the governor pursuant to section 26-34; provided that the term of the member appointed pursuant to this paragraph shall be five years;

     (3)  One member who shall be a coach in the athletics department at the University of Hawaii at Manoa;

     (4)  One member to be appointed by the speaker of the house of representatives; and

     (5)  One member to be appointed by the president of the senate;

provided that all members of the board of governors shall be approved by the University of Hawaii board of regents.

     (c)  The board of governors shall select a chair from among its members; provided that the chair shall not be a member appointed by either the speaker of the house of representatives or the president of the senate.  Except for the member appointed pursuant to subsection (b)(2), the terms of the members shall be for four years and shall be subject to the term limitation requirements of section 26-34.

     (d)  The members of the board of governors shall serve without compensation, but shall be reimbursed for expenses, including travel expenses, necessary for the performance of their duties.

     (e)  The athletics department of the University of Hawaii at Manoa, through its board of governors, shall submit an annual financial and management report to the University of Hawaii board of regents, the governor, and the legislature not less than twenty days prior to the convening of each regular session of the legislature."

     SECTION 2.  Section 304A-2176, Hawaii Revised Statutes, is amended to read as follows:

     "[[]§304A-2176[]]  University of Hawaii at Manoa intercollegiate athletics special fund and University of Hawaii at Hilo intercollegiate athletics special fund.  (a)  Notwithstanding any other law to the contrary, there are established the University of Hawaii at Manoa intercollegiate athletics special fund and the University of Hawaii at Hilo intercollegiate athletics special fund for the intercollegiate athletic programs of the University of Hawaii at Manoa and the University of Hawaii at Hilo, which shall be used to receive, deposit, disburse, and account for funds from the activities of the intercollegiate athletic programs.  The board of governors of the athletics department at the University of Hawaii at Manoa shall administer the University of Hawaii at Manoa intercollegiate athletics special fund.  The university shall administer the University of Hawaii at Hilo intercollegiate athletics special fund.

     (b)  The board of governors and the university, as applicable, may establish appropriate charges for activities related to its athletic programs and the use of its athletic facilities, the proceeds from which shall be deposited into these special funds.

     The board of governors and the university, as the case may be, shall maintain the financial integrity and viability of these special funds, including the maintenance of an adequate reserve to cope with the various factors that impact the revenue structure of an intercollegiate athletic program."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2015.
