A BILL FOR AN ACT
relating to reckless endangering.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The purpose of this Act is to better protect public health by deterring reckless conduct that places innocent persons in danger of contracting a deadly disease such as coronavirus disease 2019.
SECTION 2. Section 707-714, Hawaii Revised Statutes, is amended by amending subsection (2) to read as follows:
"(2) Reckless endangering in the second degree is
a misdemeanor[.]; provided that:
(a) If the factual basis
for the offense involved the person knowingly boarding a commercial flight into
the State:
(i) After
having tested positive for an illness or disease that is spread by an airborne
pathogen; or
(ii) While
under the belief that the person may have been infected by an airborne pathogen;
and
(b) A state of emergency
has been declared for the State or county of arrival, as applicable, due to the
public health threat posed by the airborne pathogen,
then the applicable fine shall be not less than $500
and not more than $4,000, in addition to any other penalty."
SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 4. Statutory material to be repealed is bracketed and stricken. New statutory material is underscored.
SECTION 5. This Act shall take effect upon its approval.
