A BILL FOR AN ACT
relating to historic places.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 708, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§708-A Criminal trespass; historic sites. In addition to meeting all of the required elements for conviction under sections 708-813, 708-814, or 708-815, if a person is found to have criminally trespassed on property that is listed on the Hawai`i Register of Historic Places, the prescribed criminal penalty under the respective sections shall be increased to the next highest level of punishment."
SECTION 2. Chapter 708, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§708-B Criminal property damage; historic sites. In addition to meeting all of the required elements for conviction under sections 708-821, 708-822, or 708-823, if a person is found to have damaged property that is listed on the Hawai`i Register of Historic Places, the prescribed criminal penalty under the respective sections shall be increased to the next highest level of punishment."
SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun, before its effective date.
SECTION 4. New statutory material is underscored.
SECTION 5. This Act shall take effect upon its approval.
