A BILL FOR AN ACT
RELATING TO THE NATURAL ENERGY LABORATORY OF HAWAII AUTHORITY.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 227D, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§227D- Inter-agency agreements; memoranda of agreement; memoranda of understanding. (a) The authority and the department of business, economic development, and tourism may develop, enter into, and implement inter-agency agreements to coordinate resources, eliminate unnecessary duplication, and effectuate the purposes of this chapter and chapter 201, without entering into a memorandum of agreement or memorandum of understanding.
(b) In addition to any other terms or conditions required by law, any inter-agency agreement between the authority and any state agency, office, department, or other administrative subdivision shall contain the following:
(1) A termination date;
(2) A statement of intent and purpose;
(3) Terms specifying the extent of the inter-agency agreement's applicability; and
(4) Terms under which the inter-agency agreement may be modified or extended."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect on July 1, 2050.
