A BILL FOR AN ACT

 

 

relating to consumer protection.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 481B, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§481B-    Sales receipt required; cash purchases.  (a)  As used in this section, unless the context otherwise requires:

"Merchant" means any person engaged in the business of offering services or goods for sale to customers at retail.

"Sales receipt" means any documentation that substantiates the sale of services or goods from a merchant.

     (b)  Unless specifically declined by the customer, a merchant shall provide a sales receipt to any customer paying for a good or service in cash.

     (c)  A sales receipt shall, at a minimum, contain:

     (1)  The name of the merchant;

     (2)  The transaction date;

     (3)  A detailed description of the goods or services purchased;

     (4)  The amount paid; and

     (5)  Information indicating that the form of payment was in cash."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
