A BILL FOR AN ACT

 

 

RELATING TO MOTOR VEHICLES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 291C, Hawaii Revised Statutes, is amended by adding two new sections to be appropriately designated and to read as follows:

     "§291C-      Heavy trucks; left lane; interstate highways; prohibition.  (a)  A heavy truck shall be prohibited from driving in the left-most lane of an interstate highway.

     (b)  Notwithstanding subsection (a), when one lane other than the left-most lane of an interstate highway is closed by law enforcement officers or emergency services personnel because of a traffic incident or accident, a heavy truck shall be allowed to drive in the left most-lane.

     (c)  The director of transportation may declare an emergency to open the use of the left-most lane of an interstate highway to heavy trucks.

     (d)  As used in this section:

     "Heavy truck" means any motor vehicle having a gross vehicle weight of ten thousand pounds or more that is designated or used primarily for the carriage of property other than the personal effects of the driver or passengers and shall include a motor vehicle to which has been added a box, platform, or other equipment for such carriage.  A heavy truck does not include an emergency vehicle or mass transit vehicle as defined in section 291-11.6

     "Interstate highway" means any highway that is part of the Dwight D. Eisenhower National System of Interstate and Defense Highways.

     §291C-     Speed limits for trucks, truck-trailer combinations, and tractor-semitrailer combinations.  (a)  No person shall drive any of the following motor vehicles on any interstate highway at a speed exceeding ten miles per hour less than the maximum speed limit established for all other motor vehicles by official signs placed by the director of transportation on interstate highways under the director's jurisdiction:

     (1)  A truck having three or more axles;

     (2)  A truck-trailer combination; and

     (3)  A tractor-semitrailer combination.

     (b)  The director of transportation shall place signs on interstate highways under the director's jurisdiction establishing maximum speed limits for vehicles enumerated in subsection (a).

     (c)  For the purposes of this section, "interstate highway" means interstate H-1, interstate H-2, interstate H-3, interstate H-201, and route 78.

     (d)  Any person who violates subsection (a) by exceeding a posted speed limit established under this section by fifteen miles per hour or more shall be guilty of a misdemeanor and shall be sentenced without the possibility of probation as provided in section 291C-105.

     (e)  Any driver of a commercial motor vehicle holding a commercial driver's license issued by this State who is convicted of violating subsection (a) for excessive speeding involving any single offense for any speed of fifteen miles per hour or more above the posted speed limit shall be guilty of a serious traffic violation, as defined in section 286-231.

     (f)  As used in this section, "commercial motor vehicle", "tractor-semitrailer combination", "truck", and "truck-trailer combination" shall have the same meanings as those terms are defined in section 286-2."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
