A BILL FOR AN ACT
relating to ALTERNATIVE JUVENILE Education.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The department of education shall establish and maintain two alternative schools, one in the leeward school district of Oahu and one in the Honolulu school district of Oahu, to provide ongoing education to juveniles involved in the justice system or at high-risk of involvement in the justice system.
The two alternative schools shall be off-campus alternative learning centers modeled after the high core program in the central school district of Oahu. Similar to the high core program, the alternative schools shall service at-risk students from all secondary schools in the district who are referred by their home schools after all school level resources have been utilized. The alternative schools shall offer a variety of programs to meet the particular needs of their students, including full-time programs, before- and after-school programs, and twilight school programs.
A student participating in the alternative schools shall meet one or more of the following criteria:
(1) Has ten or more unauthorized absences in the current or previous quarter;
(2) Experiencing academic failure in two or more courses in the current quarter or has experienced academic failure in two or more courses in the previous quarter;
(3) Has received three or more disciplinary referrals, including disciplinary referrals for class A, B, C, or D offenses pursuant to title 8, chapter 19, Hawaii Administrative Rules;
(4) Be one or more grade levels behind other students of a comparable age;
(5) Be involved with the juvenile justice system; or
(6) Meet other at-risk factors as determined by the home school.
SECTION 2. There is appropriated out of the general revenues of the State of Hawaii the sum of $ or so much thereof as may be necessary for fiscal year 2017-2018 for the department of education to establish and maintain two alternative schools, one in the leeward school district of Oahu and one in the Honolulu school district of Oahu, to provide ongoing education to juveniles involved in the justice system or at high-risk of involvement in the justice system and to fund related expenses, including utilities, curriculum, equipment, supplies, and the hiring of necessary staff.
The sum appropriated shall be expended by the department of education for purposes of this Act.
SECTION 3. This Act shall take effect on July 1, 2017.
