A BILL FOR AN ACT

 

 

relating to piscary rights.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to preserve the piscary rights of all Hawaii residents in state waters.

     SECTION 2.  Chapter 7, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§7-    Piscary rights.  Notwithstanding any law to the contrary, the piscary rights of Hawaii residents to fish within state marine waters, as defined in section 188-22.5, shall be preserved.  For the purposes of this section "resident" means a person who has resided in the State for at least three years."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
