A BILL FOR AN ACT

 

 

RELATING TO DOMESTIC VIOLENCE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that domestic violence is a problem faced by many individuals in the community.  Currently many victims of domestic violence do not know what services are available to assist them and do not know who they can reach out to.  By requiring employers to post hotline numbers and making the numbers readily accessible, more victims of domestic violence will receive the support they need to overcome the situation.

     The purpose of this Act is to require:

     (1)  The department of human services to create a domestic violence call sheet with a domestic violence legal hotline number, a domestic violence shelter hotline number, and other relevant resources for victims of domestic violence;

     (2)  All employers to post the call sheet in the workplace; and

     (3)  Both the department of human services and the department of labor and industrial relations to make an electronic version of the call sheet available on their websites.

     SECTION 2.  Chapter 346, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§346-    Domestic violence hotline; call sheet.  (a)  The department shall create a domestic violence call sheet to include a domestic violence legal hotline number and domestic violence shelter hotline number.  The call sheet shall also include information that the department deems appropriate to assist victims of domestic violence to seek assistance from appropriate agencies and organizations.  The call sheet shall serve as a poster to be posted in businesses as required by section 371-  .

     (b)  The department shall make available on its public website an electronic version of the call sheet required by subsection (a)."

     SECTION 3.  Chapter 371, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§371-    Domestic violence hotline call sheet; posting requirement; penalty.  (a)  Every employer shall post and keep posted in a place readily accessible to individuals in the employer's employ a poster no smaller than eight and one-half inches by eleven inches in size that contains the domestic violence hotline call sheet created by the department of human services pursuant to section 346-  .

     (b)  The department shall make available on its public website an electronic version of the poster required by subsection (a) for employers to print.

     (c)  An employer who wilfully and knowingly fails, neglects, or refuses to perform any act required by this section shall be fined not more than $100 for each separate offense.  Each day the violation continues shall constitute a separate offense.  Any action taken to impose or collect the penalty provided for in this subsection shall be considered a civil action."

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect upon its approval.
