A BILL FOR AN ACT

 

 

RELATING TO RACE AND ETHNIC STANDARDS FOR FEDERAL STATISTICS AND ADMINISTRATIVE REPORTING.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that for more than twenty years, the federal Office of Management and Budget's Statistical Policy Directive No. 15, Race and Ethnic Standards for Federal Statistics and Administrative Reporting, has set forth standards for the uniform reporting of data on race and ethnicity.  Development of these standards stemmed in large measure from responsibilities to enforce civil rights laws.  This data is needed to monitor equal access in housing, education, employment, and other areas for populations that historically had experienced discrimination and differential treatment because of their race or ethnicity.

The legislature further finds that the collection of racial and ethnic data by means of compliance with the Office of Management and Budget's Statistical Policy Directive No. 15 is also important at the state level.  Consistent, reliable racial and ethnic data is vital to the development of effective policies and programs that address the needs of the various constituencies served and protected by the State.

The purpose of this Act is to ensure that the executive departments, agencies, and offices of the State comply with the Office of Management and Budget's Statistical Policy Directive No. 15, as revised.

     SECTION 2.  Chapter 26, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§26‑    Compliance with federal standards for the reporting of race and ethnic data.  (a)  All executive departments, agencies, and offices shall comply with the Office of Management and Budget's Statistical Policy Directive No. 15, Race and Ethnic Standards for Federal Statistics and Administrative Reporting, as revised, which provides standard classifications for record keeping, collection, and presentation of data on race and ethnicity in federal program administrative reporting and statistical activities.

     (b)  Any report to the federal government made pursuant to subsection (a) and any records and files or other information upon which the report is based shall constitute an excepted government record under section 92F-13."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
