A BILL FOR AN ACT

 

 

relating to juvenile justice.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that many youth currently placed in the Hawaii youth correctional facility could be safely supervised in their communities and provided with treatment and programming to reduce future delinquency in more cost-effective ways.

     The legislature further finds that in order to more effectively respond to juvenile delinquency, and to provide adequate supervision for youth in their communities, Hawaii must fund practices proven to reduce recidivism.  Funding for such evidence-based practices must take the form of an upfront investment in the initial fiscal year, followed by regular reinvestments of savings from the budget for the Hawaii youth correctional facility.

     The legislature also finds that many justice system-involved youth are in need of mental health treatment, substance abuse treatment, and other practices or interventions that are proven to reduce the likelihood of future delinquency in cost-effective ways.  It is important to fund statewide practices that are proven to address mental health and substance abuse issues.

     The purpose of this Act is to appropriate funds for evidence-based practices and programs that will reduce future delinquency by Hawaii's youth in cost-effective ways including the funding of mental health and substance abuse treatment programs.

     SECTION 2.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2014-2015 for evidence-based practices intended to reduce recidivism and improve outcomes for youth who otherwise would likely have been sent to the Hawaii youth correctional facility.

     The sum appropriated shall be expended by the family court division of the judiciary for the purposes of this Act.

     SECTION 3.  After the objectives and purposes of the appropriations made in the Hawaii youth correctional facility budget have been met, in the last month of every fiscal year, the executive director of the office of youth services shall certify to the director of finance the amount of unexpended funds due to average daily population reductions in the Hawaii youth correctional facility.  No later than July 1 of every year, the director of finance shall transfer the sum of the unexpended funds to the family court division of the judiciary to fund evidence-based practices intended to reduce recidivism and improve outcomes for youth who otherwise would likely have been sent to the Hawaii youth correctional facility.  The family court division shall divide the funds amongst the four judicial circuits in the following proportion:

     (1)  The first circuit:  forty-five per cent;

     (2)  The second circuit:  twenty-five per cent;

     (3)  The third circuit:  twenty per cent; and

     (4)  The fifth circuit:  ten per cent.

     SECTION 4.  The family court division shall submit annual reports to the legislature reporting the services or programs selected pursuant to sections 2 and 3, the number of youth served by each service or program, and the case outcomes for youth.

     SECTION 5.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2014-2015 for the office of youth services in the department of human services to contract for mental health treatment, substance abuse treatment, and practices proven to reduce the likelihood of recidivism among court-involved youth or youth placed on probation.

     The sum appropriated shall be expended by the department of human services for the purposes of this Act.

     SECTION 6.  The office of youth services shall submit annual reports to the legislature describing the services or programs selected pursuant to section 5, the number of youth served by each service or program, and the aggregate outcomes for those youth.

     SECTION 7.  This Act shall take effect on July 1, 2014.
