A BILL FOR AN ACT

 

 

relating to child safety.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1. The legislature recognizes the necessity to ensure the safety of children by reducing the proximity of registered sexual offenders to public and private schools and public parks or recreation grounds.

     SECTION 2.  Chapter 846E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§846E-   (1) A covered offender required to register under this chapter, upon initial registration or subsequent change of address, who knowingly resides within three hundred feet of any public or private school, kindergarten, preschool, public park or recreation ground shall be guilty of a class C felony."

     (2)  For the purposes of this section:

     "Public park or recreational ground" means any state, county or city designated park, public playground and public swimming pool.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
