A BILL FOR AN ACT

 

 

RELATING TO LIQUOR LICENSES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 281, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§281-    Liquor license; revocation or suspension for sustained and continuing pattern of noise, disturbance, misconduct, or disorder.  (a)  In any county with a population of five hundred thousand or more, any liquor license issued pursuant to this chapter may be revoked or suspended by the commission or liquor control adjudication board upon finding that a sustained and continuing pattern of noise, disturbance, misconduct, or disorder exists on or about the licensed premises, related to the operation of the premises or the conduct of its patrons, which adversely affects the health, welfare, or safety of the inhabitants of the area where the licensed premises is located.

     The existence of a sustained and continuing pattern of noise, disturbance, misconduct, or disorder on or about the licensed premises, related to the operation of the premises or the conduct of its patrons, will be presumed upon the fourth substantiated complaint to the commission or liquor control adjudication board by county police of noise, disturbance, misconduct, or disorder on or about the licensed premises or related to the operation of the premises or the conduct of its patrons, in any sixty-day period, absent clear and convincing evidence of either fraudulent intent on the part of any complainant or a factual error with respect to the content of any report concerning the complaint relied upon by the commission or liquor control adjudication board.

     In every case where the commission or liquor control adjudication board proposes to revoke or suspend any liquor license for a sustained and continuing pattern of noise, disturbance, misconduct, or disorder, section 281-91 shall apply.

     Any licensee aggrieved by an order revoking or suspending a liquor license under this section may appeal therefrom as provided in section 281-92."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect July 1, 2112.
