A BILL FOR AN ACT


 

 

relating to planned community associations.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 421J, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§421J-     Flag poles.  Notwithstanding any law to the contrary, no member shall be prevented by any covenant, declaration, bylaws, restriction, deed, lease, term, provision, condition, codicil, contract, or similar binding agreement, however worded, from erecting and using a flag pole for the purpose of displaying the flag of the United States or of the State on the premises of any detached single-family residential dwelling or townhouse that the member owns; provided that the board of directors may implement reasonable restrictions with regard to flag poles, including but not limited to size and location, that do not prohibit the erection and use of flag poles altogether."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.

Description:

Allows for the use of flag poles to display the flag of the United States or of the State on the premises of single-family residential dwellings or townhouses that are part of a planned community.  Allows reasonable restrictions on the use of flag poles for aesthetic purposes.
