A BILL FOR AN ACT

 

 

relating to THE recording of board meetings.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the state open meetings law, section 92-9, Hawaii Revised Statutes, also known as the sunshine law, gives citizens the right to record a meeting of a public board using a tape recorder or any other means of sonic reproduction.  A plain reading of this section may arguably exclude video recordings, even though the office of information practices may interpret it as including video.  When the law was enacted thirty-five years ago, video recordings were not prevalent, but technological advances have made them commonplace and even preferred over audio recordings.

     The purpose of this Act is to clarify that audio and video recordings are permitted at public board meetings.

     SECTION 2.  Section 92-9, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:

     "(c)  All or any part of a meeting of a board may be recorded by any person in attendance by means of [a tape] an audio or video recorder [or any other means of sonic reproduction], except when a meeting is closed pursuant to section 92-4; provided the recording does not actively interfere with the conduct of the meeting."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
