A BILL FOR AN ACT

 

 

relating to chapter 846E, Hawaii Revised Statutes.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to prohibit the publication or republication of a sex offender's public information when a court has terminated the offender's registration requirements pursuant to section 846E-10, Hawaii Revised Statutes.  Upon termination, the offender's public information is removed from the state sex offender registry.  However, third parties that have republished data taken from the state sex offender registry do not always remove terminated registrations, which may result in confusion and inaccurate information being conveyed to the general public. 

     Accordingly, this purpose of this Act is to limit republication of personal information that has been terminated to the covered offender, the attorney general, law enforcement agencies, and certain government agencies.

     SECTION 2.  Chapter 846E, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§846E-     Publication of public information; when prohibited.  Except as provided by section 846E-3, no person other than the covered offender or attorney general shall publish or republish the public information of a covered offender whose registration requirements have terminated pursuant to section 846E-10.

     As used in this section, "public information" has the same meaning as in section 846E-3."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  This Act shall take effect upon its approval.
