A BILL FOR AN ACT

 

 

RELATING TO PUBLIC SAFETY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that development and redevelopment in the Kakaako district, including transit-oriented development, is proceeding at a rapid pace with mixed-density high-rise and low-rise residential and commercial buildings under construction and scheduled for completion between 2016 and 2020.  State of Hawaii and city and county of Honolulu complete street transportation policies emphasize and prioritize active streets, where pedestrians, bicyclists, and transit riders of all ages, in addition to motorists, can safely make full use of roadways and streets.

     With Kakaako development under the jurisdiction of the Hawaii community development authority (HCDA), the State has a vested interest in ensuring that all streets in Kakaako are in-fact safe for all pedestrians, residents, and drivers.  This is especially true as HCDA transitions Kakaako into a thriving neighborhood with activated streets, containing inviting open spaces, networked walking paths, retail experiences, and art and cultural displays.

     The legislature also finds that Kakaako is a district wherein certain privately owned streets connect and intersect with heavily-traveled state and city streets.  Consistent with the complete streets principle that complete streets are connected streets providing pedestrians, bicyclists, and motorists the most direct routes to their destinations, the public in Kakaako often transition between state, city, and privately-owned streets.

     Accordingly, the legislature finds that privately owned streets should not make use of the sidewalk inconsistent with or in frustration of the sidewalk's intended use by the public.  Such inconsistent use would necessarily jeopardize the health, safety, and welfare of the public.

     SECTION 2.  Chapter 206E, Hawaii Revised Statutes, is amended by adding a new section to Part II to be appropriately designated and to read as follows:

     "§206E-    Parking on sidewalks.  (a)  The authority shall, with respect to private streets in the Kakaako community development district that are expressly or impliedly dedicated to the public, prohibit or restrict the stopping, standing, or parking of vehicles on sidewalks.

     (b)  For purposes of this section, "sidewalks" and "streets" shall have the same meaning as in section 291C-1."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2050.
