A BILL FOR AN ACT

 

 

relating to transportation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the State, due to its unique geographical location, is vulnerable to various natural disasters.  In times of disaster, having multiple transportation routes for ingress and egress is essential for the safety and well-being of residents.  There is a need to leverage federal funds to ensure the construction and maintenance of these alternative routes.

     The purpose of this Act is to establish a surcharge on the sale of new motor vehicles to fund transportation projects to develop alternative transportation routes in the State.

     SECTION 2.  Chapter 237, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§237-     Alternative routes surcharge.  (a)  There is hereby levied and shall be assessed and collected against new motor vehicle dealers in the State a surcharge equivalent to      per cent of the gross proceeds of sales of new motor vehicles.

     (b)  All moneys received under this section shall be deposited into the alternative route special fund established under section 264-   .

     (c)  For purposes of this section:

     "New motor vehicle" has the same meaning as in section 437‑1.

     "New motor vehicle dealer" has the same meaning as in section 437‑1."

     SECTION 3.  Chapter 264, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§264-     Alternative routes special fund.  (a)  There is established in the state treasury the alternative routes special fund to be administered by the department, in which shall be deposited:

     (1)  Moneys collected under section 237-   ; and

     (2)  Appropriations made by the legislature.

     (b)  Moneys in the alternative routes special fund shall be used for the construction of public highways that are intended to serve as alternative routes."

     SECTION 4.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on July 1, 2024.
