A BILL FOR AN ACT
relating to leed certification.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Developed by the United States Green Building Council, LEED, Leadership in Energy and Environmental Design, is a set of rating systems for the design, construction, operation, and maintenance of buildings and neighborhoods that are environmentally responsible and use resources efficiently. Begun in 1998, LEED standards are internationally-recognized and employed in more than thirty countries.
The legislature finds that LEED certification is a five-step process that begins with the choice of which rating system to use, involves an application review, and permits an appeal of the certification decision. Certification is achieved when a project earns points within LEED credit categories, including sustainable sites credits, water efficiency credits, energy and atmosphere credits, materials and resources credits, and indoor environmental quality credits. The number of points a project earns determines its level of LEED certification.
The legislature further finds that LEED-certified buildings generally require fewer resources to operate and are more efficient in their operations, thereby freeing resources for additional uses, including economic development and job creation.
Accordingly, the purpose of this Act is to require all newly-constructed public buildings, facilities, and schools to be designed and constructed to obtain LEED certification and that state departments responsible for the design and construction of such facilities obtain LEED certification.
SECTION 2. Chapter 196, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:
"§196- State facilities; public schools; LEED certification. (a) Each state department with responsibilities for the design and construction of public buildings and facilities, including public schools, shall ensure that newly-constructed public buildings, facilities, and schools are designed and constructed in such a manner as to obtain LEED certification according to at least one LEED rating system.
(b) Upon completion of a newly constructed public building, facility, or school, the state department responsible for the design and construction shall apply for and obtain LEED certification. If certification is not initially granted, the relevant state department shall take all necessary steps to achieve certification.
(c) As used in this section, "LEED" means Leadership in Energy and Environmental Design developed by the United States Green Building Council, which is the set of rating systems for the design, construction, operation, and maintenance of buildings that are environmentally responsible and use resources efficiently."
SECTION 3. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 4. New statutory material is underscored.
SECTION 5. This Act shall take effect upon its approval.
