A BILL FOR AN ACT

 

 

relating to legacy lands.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to direct the board of land and natural resources to enter into negotiations to acquire those lands along the Ka ‘Iwi coast on Oahu that are in imminent danger of being developed.  The acquired land shall be held as resource value lands, also known as legacy lands, with the acquisitions to be funded from the land conservation fund.

     SECTION 2.  Notwithstanding the acquisition and application provisions set forth in section 173A-5(h) and (i), Hawaii Revised Statutes, the board of land and natural resources shall enter into negotiations to acquire land along the Ka ‘Iwi coast that is in imminent danger of being developed.  The board shall exercise its authority pursuant to section 173A-4, Hawaii Revised Statutes, to acquire the land.

     SECTION 3.  There is appropriated out of the general revenues of the State of Hawaii the sum of $           or so much thereof as may be necessary for fiscal year 2011-2012 and the same sum or so much thereof as may be necessary for fiscal year 2012-2013 for deposit into the land conservation fund.

     SECTION 4.  There is appropriated out of the land conservation fund the sum of $           or so much thereof as may be necessary for fiscal year 2011-2012 and the same sum or so much thereof as may be necessary for fiscal year 2012-2013 to acquire certain land along the Ka 'Iwi coast on Oahu that is in imminent danger of being developed.

     The sums appropriated shall be expended by the board of land and natural resources for the purposes of this Act.

     SECTION 5.  The land acquired pursuant to this Act shall be held as resource value land, pursuant to the provisions of chapter 173A, Hawaii Revised Statutes.

     SECTION 6.  This Act shall take effect on July 1, 2011.
