A BILL FOR AN ACT

 

 

relating to public lands.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 171, Hawaii Revised Statutes, is amended by adding a new section to part I and to be appropriately designated and to read as follows:

     "§171-     Special public meeting requirements; Banyan drive resort area.  (a)  Notwithstanding any law to the contrary, when rendering a decision regarding:

     (1)  The issuance of new leases;

     (2)  The renewal or amendment of existing leases;

     (3)  The termination of leases; or

     (4)  The disposition of any lands affected;

pursuant to the authorization to issue leases under section 2 of Act 55, Session Laws of Hawaii 2000, the board of land and natural resources shall hold at least two public hearings in the Banyan drive resort area; provided that the board shall hold an initial public hearing to provide the general public with an opportunity to be heard and a separate public hearing to render its decision on the matter.  The hearing requirements established under this section shall remain in force for as long as the board maintains management authority over the leased lands in the Banyan drive resort area."

     SECTION 2.  This Act shall take effect upon its approval.
