A BILL FOR AN ACT

 

 

relating to youth sports.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to increase child safety by establishing standards and regulations for youth sports coaches.

     SECTION 2.  The Hawaii Revised Statutes is amended by adding a new chapter to be appropriately designated and to read as follows:

"Chapter

YOUTH SPORTS COACH

     §   -1  Definitions.  As used in this chapter:

     "Department" means the department of commerce and consumer affairs.

     "Youth sports coach" means a coach involved in the Hawaii High School Athletic Association or any county, business, or nonprofit organization that organizes a youth athletic activity and charges a fee to participate.

     §   -2  Youth sports coach; permit required.  (a)  Every youth sports coach shall obtain a permit from the department before teaching or training any athlete on the team in which the youth sport coach is coaching; provided that only one permit per year shall be required for a youth sports coach who coaches multiple teams.

     (b)  The department shall adopt rules pursuant to chapter 91 that establish permit requirements for youth sports coaches that include:

     (1)  Training requirements;

     (2)  CPR and first aid training requirements;

     (3)  Concussion education requirements; and

     (4)  Background checks.

     §   -3  Permit; fees.  (a)  Any person desiring the permit required by section    -2 shall apply to the department for a permit on a form and in a manner prescribed by the department.

     (b)  The permit shall be valid for one year.

     (c)  The department shall charge a reasonable permit processing fee.

     §   -4  Civil penalties.  Any person who violates any provision of this chapter or the rules of the department adopted pursuant to this chapter shall be fined not more than $1,000.  Each day's violation or failure to comply shall be deemed a separate offense.

     Unless otherwise expressly provided, the remedies or penalties provided in this chapter are cumulative to each other and to the remedies or penalties available under all other laws of this State."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  This Act shall take effect upon its approval.
