A BILL FOR AN ACT

 

 

relating to resource conservation.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that federal energy efficiency and water conservation standards have saved citizens trillions of dollars, have prevented billions of metric tons of carbon dioxide emissions, and have helped to protect the environment.

     The legislature further finds that President Donald Trump has proposed to drastically cut or eliminate many federal energy efficiency and water conservation programs and standards.  In response, California and Vermont have enacted legislation to automatically adopt current federal energy efficiency and water conservation standards should the federal government eliminate or reduce those standards.

     The purpose of this Act is to protect the environment by requiring Hawaii to adopt or exceed various current federal energy efficiency and water conservation standards if the federal government eliminates or reduces those standards.

     SECTION 2.  Chapter 196, Hawaii Revised Statutes, is amended by adding a new section to part I to be appropriately designated and to read as follows:

     "§196-     Energy efficiency and water conservation standards; rules.  (a)  The commission shall adopt rules pursuant to chapter 91 that adopt or exceed the minimum energy efficiency and water conservation standards for each product that is subject to a standard under 10 C.F.R. sections 430 and 431 as those provisions existed on January 19, 2017.  The rules shall prohibit any person from selling or offering for sale a new product subject to the standard unless the energy efficiency or water conservation of the new product meets or exceeds the requirements set forth in the standard.

     (b)  The minimum standard and the testing protocol for each product shall be the same as or exceed those adopted in sections of the Code of Federal Regulations referenced in subsection (a).

     (c)  The commission shall adopt a minimum standard for general service lamps that is forty-five or more lumens per watt, when tested in accordance with 10 C.F.R. section 430.23(gg) as that provision existed on January 19, 2017.  For purposes of this subsection, "general service lamp" shall have the same meaning as set forth in 82 Federal Register 7276, 7321-7322, as amended by 82 Federal Register 7322, 7333.

     (d)  Each rule adopted pursuant to this section shall not be enforceable until:

     (1)  The federal energy efficiency or water conservation standard for the product addressed by that rule under 42 U.S.C. chapter 77 is withdrawn, repealed, or otherwise voided; provided that this paragraph shall not apply to any federal energy efficiency or water conservation standard set aside by a court of competent jurisdiction upon the petition of a person who will be adversely affected, as provided in 42 U.S.C. section 6306(b); or

     (2)  A waiver of federal preemption is issued for the product addressed by that rule pursuant to 42 U.S.C.  section 6297.

     The federal standard for general service lamps shall be considered to be withdrawn, repealed, or otherwise voided if it does not come into effect on January 20, 2020, pursuant to the actions published at 82 Fed. Reg. 7276 and 7333."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
