A BILL FOR AN ACT

 

 

relating to adult care.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that when a resident of an adult residential care home, an expanded adult residential care home, or an adult foster home is admitted to a hospital, the length of hospital stay is often unknown.  The empty bed leaves the care home with a financial loss of income and uncertainty as to when the income will return.  The legislature further finds that when some care home residents are discharged from a hospital and require an increased level of care, care homes that are not authorized to provide that level of care are often forced to accept those residents.

     The purpose of this Act is to authorize adult residential care homes, expanded adult residential care homes, and adult foster homes to deny readmission to patients who have been admitted to a hospital for a specified period of time or who, upon discharge from the hospital, require a level of care the care home is not authorized to provide.

     SECTION 2.  Chapter 321, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§321-     Readmission following hospital care.  (a)  No adult residential care home, expanded adult residential care home, or adult foster home shall be required to readmit a resident who:

     (1)  Has been admitted to a hospital for inpatient care for a duration of five consecutive days or more; or

     (2)  Upon discharge from the hospital, requires a level of care that the adult residential care home, expanded adult residential care home, or adult foster home is not authorized to provide.

     (b)  No hospital shall discharge a patient to an adult residential care home, expanded adult residential care home, or adult foster home without the consent of the adult residential care home, expanded adult residential care home, or adult foster home."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
