A BILL FOR AN ACT
relating to electronic smoking devices.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. Chapter 328J, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:
"§328J- Electronic
smoking device disposal program; retail tobacco stores. (a)
The department shall establish and administer an electronic smoking
device disposal program for the collection and disposal of electronic smoking
devices that contain rechargeable lithium-ion batteries. The disposal program shall include disposal
procedures or processes that are consistent with all applicable state and
county statutes, rules, or ordinances."
(b) Every retail tobacco store that sells
electronic smoking devices shall participate in the electronic smoking device
disposal program.
(c) A retail tobacco store that fails to collect
and dispose of electronic smoking devices pursuant to this section and rules
adopted by the department shall be subject to a fine of no more than
$ .
(d) The department shall adopt rules pursuant to
chapter 91 to carry out the purposes of this section."
SECTION 2. This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.
SECTION 3. New statutory material is underscored.
SECTION 4. This Act shall take effect upon its approval.
