A BILL FOR AN ACT

 

 

RELATING TO THE OFFICE OF INFORMATION PRACTICES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The legislature finds that the office of information practices does not currently have a formal means of receiving advice on the office's actions in administering Hawaii's sunshine law.

     The purpose of this act is to establish a board of information practices, composed of appointees of the governor, speaker of the house of representatives, senate president, and county mayors, to comment on the office's proposals and reports.

     SECTION 2.  Section 92-1-5, Hawaii Revised Statutes, is amended to read as follows:

     "§[[]92-1.5[]]  Administration of this part[.]; board of information practices.  (a)  The director of the office of information practices shall administer this part.  The director shall establish procedures for filing and responding to complaints filed by any person concerning the failure of any board to comply with this part.  The director of the office of information practices shall submit an annual report of these complaints along with the final resolution of complaints, and other statistical data to the legislature, no later than twenty days prior to the convening of each regular session.

     (b)  There is created in the office of information practices a board of information practices consisting of nine members.  Three members shall be appointed by the governor in accordance with section 26-34.  One member each shall be appointed by the president of the senate and the speaker of the house of representatives.  One member shall be from each of the four counties, appointed by the mayor and approved by the council of the county in which the member resides.  Each member shall serve a term of three years, provided that the initial appointments of the four members representing the counties shall be for a period of two years.  The chairperson of the board of information practices shall be elected annually by the members of the board.  The members shall serve without compensation but shall be reimbursed for necessary expenses, including travel expenses, in attending meetings of the board of information practices.  The board of information practices shall determine its internal rules of procedure, and shall be supported administratively by the office of information practices.

     (c)  The director of the office of information practices shall provide a reasonable opportunity for the board of information practices to comment on proposals and reports, made or advocated by the director, including administrative rules, budgets, and legislation.  The board of information practices shall perform other functions as provided by administrative rules or other laws."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
